Welcome to Flobee Designs. These Terms & Conditions explain the terms that apply when you use our website or purchase products from us.

Flobee Designs is a family-run business based in Hinckley, Leicestershire, creating personalised gifts, keepsakes, home décor, celebration products, baby and children’s products and other personalised items.

By placing an order with us, you agree to these Terms & Conditions.

Flobee Designs is the trading name/brand under which our products are sold.

If you have any questions about these Terms & Conditions or an order, please contact us using the contact details provided on our website.

 

2. OUR PRODUCTS

We specialise in personalised and handmade products.

Because many of our products are handmade or produced specifically for each customer, small variations may occur in colour, grain, finish, dimensions or appearance.

Where a product is made from natural materials such as wood or bamboo, natural characteristics including grain patterns, knots, markings and variations in colour are not considered defects.

Product photographs are intended to provide an accurate representation of our products. However, colours may appear slightly different depending on your device, screen settings and lighting conditions.

Measurements stated on product listings are approximate unless specifically stated otherwise.

Where a product is made to a particular size or specification, the relevant product description will provide the applicable measurements.

 

3. PERSONALISATION

It is your responsibility to make sure that all personalisation details supplied when placing an order are correct.

This includes, but is not limited to:

names;
spelling;
dates;
ages;
wording;
colours;
sizes;
design choices; and
any other information supplied for personalisation.
We will normally produce your item using the information supplied with your order.

We are not responsible for spelling mistakes, incorrect dates or other errors in personalisation information supplied by you.

We strongly recommend checking your order carefully before completing payment.

If you contact us promptly after placing an order and production has not yet started, we will do our best to make amendments where reasonably possible.

Once production has started, we may be unable to make amendments or cancel the order.

 

4. CUSTOM AND BESPOKE ORDERS

We accept custom and bespoke orders.

Where a design has been created specifically for you, we may discuss the requirements with you before production begins.

A custom order will not normally enter production until the required details have been agreed and payment has been received.

Because bespoke products are created specifically for an individual customer, the normal change-of-mind cancellation rights may not apply where the goods are made to the customer’s specifications or clearly personalised.

This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise fail to meet the requirements of applicable consumer law.

 

5. PLACING AN ORDER

When you place an order, you are making an offer to purchase the products selected.

After you place an order, you should receive an order confirmation.

An order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted if there is a genuine issue affecting the order.

We reserve the right to contact you if:

an item is unavailable;
there is an obvious pricing or description error;
the personalisation supplied is unclear or cannot reasonably be produced;
we reasonably believe an order has been placed fraudulently; or
there is another genuine reason why we cannot fulfil the order.
If we cannot fulfil an order and payment has already been taken, we will arrange an appropriate refund.

 

6. PRICES

All prices displayed on our website are in pounds sterling (£).

Unless stated otherwise, the price shown for a product is the price payable for that product.

Delivery charges are shown separately where applicable.

We take reasonable care to ensure that prices and product information are accurate. If we discover an obvious error in the price of a product before an order is fulfilled, we will contact you before proceeding.

You will not be required to pay an incorrect higher price caused by an obvious pricing error without your agreement.

 

7. PAYMENT

Payment must be made through the payment methods available at checkout.

We do not normally begin production of personalised or bespoke items until payment has been successfully received.

You must provide accurate billing and delivery information when placing your order.

 

8. PRODUCTION TIMES

Our standard production time is normally 5–7 working days, unless otherwise stated on the product page or at checkout.

Production time refers to the time required for us to make and prepare your order.

It does not necessarily include the time taken by the delivery provider to deliver the parcel to you.

We also offer an express production option on eligible orders, please check listings for full details.

Express production does not necessarily mean next-day delivery unless this is specifically stated at checkout.

Production times may occasionally be affected by circumstances outside our reasonable control, including unusually high order volumes, supplier problems, equipment failure, severe weather or delivery disruption.

Where there is a significant delay, we will make reasonable efforts to keep you informed.

 

9. DELIVERY

We will deliver your order to the delivery address supplied when you place your order.

Please ensure that your delivery address is correct.

Once an order has been dispatched, delivery is normally handled by the third-party delivery provider selected by us.

Delivery times quoted are estimates unless a specific guaranteed delivery service has been purchased and expressly confirmed.

If an order is returned to us because an incorrect or incomplete address was supplied, additional delivery charges may apply before the order can be resent.

Where goods are damaged in transit, please contact us as soon as reasonably possible and provide photographs of the packaging and damaged item where possible.

 

10. PERSONAL FINANCIAL OR OTHER INFORMATION

We do not store or have access to your full payment card details where payment is processed through our third-party payment providers.

Your personal information is handled in accordance with our Privacy Policy.

 

11. CANCELLATION AND CHANGE-OF-MIND RIGHTS

For many non-personalised goods purchased online, consumers have a statutory right to cancel their order within the applicable cancellation period under UK consumer law.

However, this right does not generally apply to goods that are:

made to the consumer’s specifications; or
clearly personalised.
Because a large proportion of Flobee Designs products are personalised, the statutory change-of-mind cancellation right may therefore not apply to those products.

For non-personalised products where a statutory cancellation right applies, the relevant cancellation and return rights will apply.

Nothing in these Terms & Conditions is intended to remove or restrict any legal right that cannot lawfully be excluded.

 

12. RETURNS

Our returns policy applies alongside these Terms & Conditions.

Where a customer has a legal right to return goods because they have changed their mind, you must notify us of your decision to cancel your order within the 14 day cooling off period. Once you have notified us you wish to cancel, the item(s) must then be returned to us within 14 days of the date you notified us of your cancellation.  

For personalised products, the normal change-of-mind cancellation right will generally not apply because the product has been made specifically for you.

This does not prevent you from exercising your statutory rights where an item is:

faulty;
damaged;
not as described;
not of satisfactory quality; or
not fit for its intended purpose.


13. FAULTY, DAMAGED OR INCORRECT PRODUCTS

If your product arrives damaged, faulty or materially different from what you ordered, please contact us as soon as reasonably possible.

We may ask for photographs or other information to help us investigate the problem.

Where a product does not meet your statutory consumer rights, we will provide the remedy required by law.

Depending on the circumstances, this may include repair, replacement, refund or another appropriate remedy.

Your statutory rights are not affected by these Terms & Conditions.

 

14. PERSONALISATION ERRORS

If an item has been produced exactly in accordance with the personalisation information supplied by the customer but the customer subsequently realises that they entered incorrect information, this will generally not constitute a manufacturing fault.

For example, if a customer enters a child’s name incorrectly when ordering a personalised product and the product is produced using that spelling, we will not normally be responsible for the customer’s error.

However, if we make an error when transferring the information supplied by the customer to the product, please contact us so that we can investigate and put the matter right where appropriate.

 

15. HANDMADE AND NATURAL MATERIAL VARIATIONS

Many Flobee Designs products are handmade or produced individually.

Minor differences between products are therefore normal and may include:

slight differences in dimensions;
wood grain;
knots and natural markings;
colour variation;
small differences in engraving;
minor differences in finish; and
slight differences caused by the handmade production process.
Such variations will not normally constitute a defect where the product remains as described and fit for its intended purpose.

 

16. PRODUCT SAFETY

Some Flobee Designs products are intended for babies and children.

Customers must read and follow any care instructions, warnings and usage information supplied with the product or displayed on the relevant product page.

Products must only be used for their intended purpose and in accordance with the applicable instructions.

Children’s products, feeding products, teethers and similar items should be used with appropriate adult supervision.

Customers should inspect products before use and discontinue use if a product becomes damaged or unsafe.

Nothing in these Terms & Conditions limits any legal responsibility we may have for product safety or defective products.

 

17. CARE OF PRODUCTS

Some products require specific care to maintain their condition and safe use.

Care instructions are provided on our website and/or with relevant products.

Damage resulting from failure to follow reasonable care instructions may not be treated in the same way as a manufacturing defect, subject always to your statutory rights.

 

18. COPYRIGHT AND INTELLECTUAL PROPERTY

All designs, photographs, graphics, logos, written content, product designs and other material displayed on the Flobee Designs website are owned by or licensed to Flobee Designs unless otherwise stated.

You may not reproduce, copy, modify, distribute or commercially exploit our designs, photographs, artwork, website content or other intellectual property without our prior written permission.

Purchasing a personalised product does not transfer ownership of the underlying design or intellectual property to the customer.

 

19. CUSTOMER-SUPPLIED DESIGNS AND CONTENT

If you provide photographs, artwork, logos, text or other material for use in a custom order, you confirm that you have the necessary rights or permission to provide that material to us.

You must not provide material that infringes another person’s copyright, trademark or other intellectual property rights.

We reserve the right to refuse a custom order where we reasonably believe the requested design may infringe another person’s rights or may be unlawful or inappropriate.

 

20. PHOTOGRAPHS OF CUSTOM ORDERS

We may wish to photograph completed products for use in our website, social media, advertising or portfolio.

We will not use personal information supplied by you for marketing purposes without an appropriate lawful basis or consent where required.

If you do not want your specific personalised order to be used in marketing material, please let us know.

 

21. WEBSITE USE

You agree not to use our website:

for any unlawful purpose;
to attempt to gain unauthorised access to our systems;
to introduce malicious software;
to interfere with the operation of the website;
to copy or commercially exploit website content without permission; or
in a way that could damage Flobee Designs or other users.
We may restrict access to the website where reasonably necessary for security, maintenance or other legitimate business purposes.

 

22. THIRD-PARTY SERVICES

Our website may use third-party services, including payment providers, delivery providers, website hosting services and other technology providers.

Where a third-party service is used to process part of your order or payment, that service may have its own terms and privacy policy.

Nothing in these Terms & Conditions limits any rights you have against us under applicable consumer law.

 

23. OUR LIABILITY

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms & Conditions excludes or limits liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
defective products where liability cannot legally be excluded;
breach of your statutory consumer rights; or
any other liability that cannot legally be excluded or limited.
Subject to the above, we will only be responsible for losses that are reasonably foreseeable and directly caused by our breach of these Terms & Conditions or applicable law.

If you are purchasing as a consumer, nothing in these Terms & Conditions affects your statutory rights.

 

24. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delays caused by circumstances outside our reasonable control.

Examples may include:

severe weather;
flooding;
fire;
power failure;
equipment failure;
supplier shortages;
postal or courier disruption;
industrial action;
government restrictions;
major IT failures; or
other events beyond our reasonable control.
Where such an event occurs, we will take reasonable steps to minimise the effect on your order.

 

25. OUR RIGHT TO CANCEL AN ORDER

We may cancel an order before production where there is a genuine reason that prevents us from fulfilling it.

Examples may include:

a product being unavailable;
an obvious pricing error;
an inability to obtain necessary materials;
a custom request that cannot reasonably be produced;
suspected fraudulent activity; or
content that we reasonably believe is unlawful or infringes another person’s rights.
Where we cancel an order after payment has been taken and no alternative arrangement is agreed, we will provide an appropriate refund.

 

26. COMPLAINTS

We want to resolve problems quickly and fairly.

If you are unhappy with an order, please contact us with:

your order number;
your name;
details of the issue; and
photographs where relevant.
We will investigate the matter and aim to resolve it as quickly as reasonably possible.

Nothing in our complaints process affects your statutory rights.

 

27. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time.

The version applicable to an order will generally be the version in force when that order was placed.

Any changes will be published on this page.

 

28. GOVERNING LAW

These Terms & Conditions are governed by the law of England and Wales.

If you are a consumer living in Scotland or Northern Ireland, you may also have rights under the laws applicable in your part of the United Kingdom.

Nothing in these Terms & Conditions prevents you from relying on any mandatory consumer protection rights available to you.

 

29. SEVERABILITY

If any part of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

 

30. ENTIRE AGREEMENT

These Terms & Conditions, together with the relevant product description, delivery information, refund policy and privacy policy, form the terms applicable to purchases made through the Flobee Designs website.

Where there is a conflict between these Terms & Conditions and a mandatory legal consumer right, the legal consumer right will prevail.
